Two Kentucky Fried Chicken restaurants close in Buffalo, New York, USA

At least two Kentucky Fried Chicken [KFC] restaurants, operated by G & H Restaurant Specialties, have closed in Buffalo, New York “for remodeling,” according to signs placed on the front doors of at least one location on Elmwood Avenue and Bryant Street in Buffalo. The other KFC is located on East Delavan Avenue, also in the City of Buffalo.

Despite the claim of closing for remodeling, the Erie County Health Department says that several health code violations were found at both locations. The most recent violation was logged by the health department in March at the Elmwood location for failing to keep food stored at correct temperatures. Violations were also cited for failing to keep cooking supplies and equipment sanitary and for not supplying hot water to the bathroom for employees.

G & H Restaurant Specialties has not released a statement regarding the violations, but the corporate offices in Louisville, Kentucky for KFC said, “our franchisee has finalized a plan for some structural repairs… The units will be temporarily closed while these building maintenance issues are addressed. [They will be] re-opened as soon as the repairs are complete.”

The health department also gave violations out to the East Delevan store for failing to maintain a clean floor throughout the restaurant and for not stopping food from becoming contaminated. Several rat traps were also found inside the storage cooler and around the kitchen area, but the establishment was “not free of rodents,” said Commissioner of the Erie County Health Department, Dr. Anthony Billittier.

Billittier also said that caulking and traps were seen on the outside of the East Delevan restaurant, which was an attempt to keep the rats out. “It shows that they’re trying to take care of a problem. But it also shows that they have a problem.”

As of Thursday, May 10, 2007, the Elmwood KFC has yet to reopen. It is not known if the East Delevan location opened today or not.

Dell delays filing of financials as accounting investigation continues

Dell Inc., a global leader in computer hardware manufacturing and sales, announced yesterday that it will delay filing of its annual performance report, the Form 10-K, required for compliance with U.S. Securities and Exchange Commission (SEC) and Nasdaq listing rules.

In a press release, Dell explained that an audit committee of the company’s board of directors is carrying out an investigation into accounting and financial reporting issues. The company stated that it would delay filing of the 10-K since the investigation had not been completed.

The internal investigation has found evidence of accounting errors, misconduct, and deficiencies in areas of financial control.

The chairman of Dell’s audit committee, Thomas Luce III, indicated that the delay in filing would extend past the April 3, 2007 deadline as well as an April 18, 2007 extension date. “As we move toward the conclusion of our investigation, we are committing the time and resources required to ensure a thorough and comprehensive review and resolution of all identified issues and the implementation of appropriate remedial measures,” said Luce.

The investigation is to determine whether the restatement of any financial disclosures are warranted, based on the accounting errors identified. The probe will also assess whether there are deficiencies in Dell’s internal control over financial reporting.

Australian troops land in East Timor

After approximately 150 Australian troops from 4 Royal Australian Regiment (Commandos) secured Comoro airport in Dili yesterday, the total number of Australian troops in East Timor has risen to 600, with a further 1200 in transit or directly supporting Operation Astute. Malaysia, New Zealand and Portugal have also begun their deployments. Malaysia has now sent 25 military officers ahead of its 500 strong commitment of military and police personnel; New Zealand has committed two C-130s, and an infantry company is on standby pending negotiations over rules of engagement; Portugal’s 120-strong commitment has commenced preparations, but is not expected to arrive for a matter of weeks. The Australian contingent involved in Operation Astute has been placed under the command of Brigadier Michael Slater, who arrived in Dili this morning.

Currently, the Australian Department of Defence states Operation Astute’s tasks are:

  1. to facilitate the evacuation of Australian and other foreign nationals as is appropriate and necessary;
  2. to stabilise the situation and facilitate the concentration of the various conflicting groups into safe and secure locations;
  3. to audit and account for the location of weapons that belong to each group; and
  4. to create a secure environment for the conduct of a successful dialogue to resolve the current crisis.

Australian forces are already actively operating in Dili; Infantry patrols are operating in the area, supported by the four Blackhawks from the 5th Aviation Regiment that have arrived so far. Blackhawks have also been operating missions above the hills around Dili to seek out rebel positions and communicate a strong presence to the rebel soldiers. Two Armoured Personnel Carriers and an infantry platoon have set up position in and around the UN Headquarters and Dili police station, which came under attack earlier today, and was the location of considerable violence yesterday when East Timorese army soldiers killed 12 East Timorese police and wounded numerous others, including 2 UN personnel. “At the moment things are relatively stable, the troops are arriving and we are establishing good control throughout the Dili area” BRIG Slater said of the situation.

Yesterday 80 Australian nationals were evacuated by RAAF C-130, a number that is rising as flights in and out of East Timor have been unhampered since the securing of Comoro airport. Approximately 800 Australian nationals were in East Timor at the beginning of conflict.

Events involving East Timor’s government are complicating the situation. Reports state that Prime Minister Mari Alkatiri is reluctant to allow foreign troops to independently operate in the country and arguing with President Xanana Gusmao over who should control the small nation’s still loyal military of 800 troops. After President Gusmao declared he had taken over command of the military and ordered all East Timorese military personnel to barracks, Alkatiri stated that he believed the President does not have a constitutional right to take control of the military, as that depends on a ‘situation of emergency’ being declared, which is itself dependent on the parliament.

According to Mark Thompson, a military budgeting specialist from the Australian Strategic Policy Institute, Operation Astute would cost a similar amount to Australia’s earlier peacekeeping operation in East Timor – approximately $200 million.

American Morality A Glimmer Of Hope On The Horizon

Has the United States lost it’s basic principle of morality? Has the United States moved away from the guiding principles that this country was founded on? A single line from the Declaration of Independence describes these basic principles, and it is the meaning of these words which provided the foundation for the formation of the United States:

“We hold these truths to be self evident: that all men are created equal; that they are endowed by their Creator with certain unalienable rights; that among these are life, liberty, and the pursuit of happiness.” – Thomas Jefferson

All Americans are created equal and life, liberty, and the pursuit of happiness is a right granted to every citizen of the United States. Our founding fathers acquired these principles from their religious beliefs, and regardless of what people may think, the United States was founded on Biblical principles. Our founding fathers did not use certain aspects of the Bible just to satisfy what they wanted in a country. They used the Bible as a whole in order to create an understanding of what the basic rights are for an individual. They concluded that these rights are from God and are given to all individuals.

One of the unalienable rights given by our creator is the right to live our lives. Our creator placed each individual on this earth for a reason. Is it not true that other people in the world have that same unalienable right to live and fulfill God’s purpose? So, if this is a founding principle for our country, does it not follow that we as a country should help others less fortunate then us? Should not others, who were born in underdeveloped countries, have the same right to life? In this article, I will address some of these questions, with the hope that by examining these issues, we can as a society, move in a direction our founding fathers had envisioned. Americans have lost site of the fact that excess without giving is not really what our founding fathers had in mind. Lets examine some examples which are symbolic of this immorality that currently exists within the American society.

Before presenting this first example, we need to have a clear definition of what morality is. From WordNet, a lexical database for the English language, developed at the Cognitive Science Library at Princeton University, morality is concern with the distinction between good and evil or right and wrong. This first example of immorality may be considered by many as one that does not have anything to do with morality, but if you give it more then cursory thought, you would most likely consider it a morality issue.

This first example has to do with Americans and their relationship with their automobiles. Yes, immorality can be seen at such a insignificant level. More importantly, this example shows the pervasiveness of immorality within the American society. Most Americans, if typical, need an automobile for basic functioning within most areas of the United States. The automobile has become a perfunctory status symbol. Many people within the United States can barely pay their rent or mortgage, but they will shovel out money per month on an automobile they really can not afford. They spend money per month in the form of a car payment or lease, just to have a ‘nice’ car.

The American obsession with the sport utility vehicle is one I still do not understand. One basic argument of the SUV owner is that by driving a SUV, they feel safer. If your driving skill is so poor that you can not avoid poor drivers, try working on your driving skill. This to me makes more sense then driving a tank (SUV) which consumes large quantities of fuel and concomitantly contributes to an increase in fuel demand. This increase in fuel demand drives fuel prices upward. With Americans so reliant upon their automobiles, higher fuel prices mean less extra money in their pocket. Money that could be used to help feed those dying from starvation throughout the world.

The American car companies for many years pushed the SUV on the American public, and now these car companies are suffering the consequences. The thinking as to why these companies offered these vehicles to the American public was that they thought Americans would continue in their mind set that excess is better. The American car companies today are doing poorly as a business. They have continually laid off workers in order to maintain a level of viability. They have been very slow to innovate and the federal government has had to mandate fuel efficiency. Because of their sluggish response to the need for fuel efficient vehicles, American car companies are now suffering the consequences.

On the other hand, Toyota and Honda, companies which have put fuel efficient hybrids out into the market place, are now doing very well. Toyota is now the number one car seller in the world. Toyota and Honda have always placed fuel efficiency as a higher priority. A glimmer of hope lies in the fact that Americans are starting to create the mind set that excess is not good, and frugality is the way of the future. Simply put, driving SUVs is not intelligent.

Driving an SUV when it really is not necessary is an example of overindulgence in the United States. Granted, there are situations where an individual needs a SUV such as Alaska or any area of the country where road conditions are poor or winters are severe. Or, there are occasions where material needs to be transported in a SUV because of it’s increase carrying capacity. In these cases, there is a legitimate reason to own a SUV because of it’s utilitarian value. But the majority of SUV owners are not in these situations or extreme conditions frequently enough to warrant owning such a fuel wasting vehicle. Driving a hybrid is an example of intelligent frugality. In order to buy a Toyota or Honda hybrid, you will have to be put on a long waiting list. This is a good sign that Americans are starting to develop the mind set that having less is better and frugality is the way of the future.

Our society has been through a period of excess and overindulgence but changes, hopefully, are on the horizon. Morality in the form of giving needs to be reincorporated back into our society. It makes more sense to drive a more fuel efficient vehicle, and use some of the saved money to contribute to the world hunger problem. For most morally conscious individuals, this type of sustained and continual activity leads to greater long term happiness.

Giving does not have to be monetary, it can be in other forms, such as giving time or knowledge. This brings us to our next example of morality reduction that has been in existence in the United States. Many parents today are not giving enough time to their children. Children need to be nurtured. A parents wisdom, gained through a life time of experiences, needs to be imparted to their children. Parents need to impart to their children the value of giving and a feeling of concern for others . When I was a child growing up, school shootings where kids are killing teachers and fellow students, was virtually unheard of. Today, school shootings are occurring at an alarming frequency. To me, part of the problem is due to parents not spending enough time with their children. Again it comes down to giving. In this case, it comes down to giving time and knowledge. Parents not giving enough time to their children is another example of morality reduction within our society.

Another example of the immorality prevalent within our society is displayed by the films which come out of Hollywood today. I am sorry to say that most of these films really are to put it bluntly, garbage. Most of these films lack the cerebral quality of the earlier films. From a technical perspective i.e. special effects, they are excellent, but from a cerebral perspective, they are lacking. Most of today’s films rely heavily on special effects in order to appeal to the audience. The common theme for today’s films almost always involves action sequences, sex, and violence. They are always trying to appeal to the dark side of human nature with very little thinking required of the audience. Therefore, most of today’s films are lacking in moral quality. They are produced only to make money for those who are producing them, without any understanding to the implications they may have on society, especially younger people.

Creativity is basically gone from Hollywood and many of the movies coming out today are remakes of successful earlier films. Once and a while a good film will be presented to the American public, but generally speaking most are junk. Most of today’s actors are not really household names. They come and go fairly quickly and lack the staying power of a John Wayne, Jimmy Stewart, or Humphrey Bogart. These actors displayed a level of integrity and they new about the personification they were displaying to the American public. They were not perfect, but they did display a higher level of morality.

Is our society spiraling downward into the oblivion of lost hope? I believe not. More and more we are seeing examples which display the positive value of giving. A case in point. Time Magazine finally got it right when they named rock star Bono, and Bill and Melinda Gates as the Persons of the Year for 2005. They were named persons of the year not because of anything that happened at Microsoft and not because Bono is a rock star, they were named persons of the year for their charitable work and activism aimed at reducing global poverty and improving world health. Finally a media organization is recognizing the value of giving.

This week, Wikinews interviewed Spanish Paralympic sport shooter Paulo Fontán Torreiro. Late last month, Galician Fontán competed at the Alicante hosted 2013 IPC European Shooting Championship, where he finished twenty-third in the R4 10-meter air rifle standing event, and fortieth in the R5 10-meter air rifle prone event.

((Wikinews)) : So you competed at the IPC European Shooting Championships last month? How did you do? Are you happy with the result? ((es))Spanish language: ?¿Compitió en el pasado Campeonato de Europa de Tiro? ¿Qué tal le fue? ¿Satisfecho por el resultado?

Paulo Fontán Torreiro: Yes, I competed in the European Championship in Alicante. It was my first important event and I felt very nervous, I wanted to perform well. Despite improving my previous scores and achieving the minimum qualifying score for next year’s World Championship, I think I could have done better. Paulo Fontán: Basically I would need to be able to train more constantly, obtain financial resources to participate in international events, and have a bit of luck on the day of the competition. Paulo Fontán: All that are included in the questions. In order to train effectively, you need adequate facilities, and that’s not the norm here. And to increase my level, I would need to compete against good rivals, basically at international events. For that, I require money and support, something that’s not too available. Paulo Fontán: I first tried other sports but finally focused on shooting because it fits my capabilities better, I’m not bad at it, and there is a very agreeable atmosphere at the competitions. Paulo Fontán: I must thank the support Juan Saavedra has given me since I started, and which he keeps giving me when I need it. Paulo Fontán: I don’t think it’s very well known, and there could be some rejection because of the “pegar tiros” part, but that’s out of ignorance since it is mainly a mental sport, a sport requiring focus. Paulo Fontán: I’ve only been doing this for three years and haven’t had time to analyze it deeply so as to have an opinion about it. ((es))Spanish language: ?Llevo sólo tres años y no he tenido tiempo de analizarlo en profundidad como para tener una opinión al respecto.

((WN)) : Would you recommend the sport to other people with disabilities? What are reasons they should or should not take up the sport? Paulo Fontán: Yes, I would recommend it, and I would because it is a sport which can be practiced by a wide array of different disabilities, and for a long time. The biggest problem is the high initial investment, the lack of adequate facilities or the cost of travelling to competitions since there are not many places that allow people with disabilities to participate. Top broker and Wall Street adviser Bernard L. Madoff, aged 70, was arrested and charged by the FBI on Thursday with a single count of securities fraud, also known as stock fraud and investment fraud. He allegedly told senior employees of his firm on Wednesday that his $50 billion business “is all just one big lie” and that it was “basically, a giant Ponzi scheme (since at least 2005).” Mr. Madoff faces up to 20 years imprisonment and a fine of up to $5 million. FBI agent Theodore Cacioppi said Mr. Madoff’s investment advisory business had “deceived investors by operating a securities business in which he traded and lost investor money, and then paid certain investors purported returns on investment with the principal received from other, different investors, which resulted in investors’ losses of approximately $50 billion dollars.”

The former chairman of the Nasdaq Stock Market is also the founder and primary owner of Bernard L. Madoff Investment Securities LLC, the closely-held market-making firm he launched in 1960. The firm is one of the top market maker firms on Wall Street. He founded his family firm with an initial investment of $5,000, after attending Hofstra University Law School. He saved the money earned from a job lifeguarding at Rockaway Beach in Queens and a part time job installing underground sprinkler systems.

A force in Wall Street trading for nearly 50 years, he has been active in the National Association of Securities Dealers (NASD), a self-regulatory organization for the U.S. securities industry. His firm was one of the five most active firms in the development of the NASDAQ, having been known for “paying for order flow,” in other word paying a broker to execute a customer’s order through Madoff. He argued that the payment to the broker did not alter the price that the customer received. He ran the investment advisory as a secretive business, however.

Dan Horwitz, counsel of Mr. Madoff, in an interview, said that “he is a longstanding leader in the financial-services industry with an unblemished record; he is a person of integrity; he intends to fight to get through this unfortunate event.” Mr. Madoff was released on his own recognizance on the same day of his arrest, after his 2 sons turned him in, and posting $10 million bail secured by his Manhattan apartment. Without entering any plea, the Court set the preliminary hearing for January 12.

Madoff’s hedge fund scheme may rank among the biggest fraud in history. When former energy trading giant Enron filed for bankruptcy in 2001, one of the largest at the time, it had $63.4 billion in assets. The scheme would dwarf past Ponzis, and it would further be nearly five times the telecommunication company WorldCom fraud and bankruptcy proceedings in 2002.

The Securities and Exchange Commission filed a separate civil suit on Thursday against Bernard L. Madoff Investment Securities and its eponymous founder Mr. Madoff. It was docketed as “U.S. v. Madoff,” 08-MAG-02735, by the U.S. District Court for the Southern District of New York (Manhattan). SEC, New York associate director of enforcement, Andrew M. Calamari, asked the judge to issue seizure orders on the firm and its assets, and appoint a receiver. The SEC pleads, among others, that “it was an ongoing $50 billion swindle; our complaint alleges a stunning fraud that appears to be of epic proportions.” It further accused the defendant of “paying returns to certain investors out of the principal received from other, different investors” for years. Madoff’s hedge fund business had previously claimed to have served between 11 and 25 clients and had $17.1 billion in assets under management. But virtually all of the assets were missing.

United States District Court for the Southern District of New York Louis L. Stanton on Thursday appointed Lee Richards, a Manhattan lawyer, as the firm’s receiver. A hearing is set for Friday, for a ruling on the SEC’s petition to grant plenary powers to the receiver over the entire firm, and an absolute asset sequestration.

Doug Kass, president of hedge fund Seabreeze Partners Management said that “this is a major blow to confidence that is already shattered — anyone on the fence will probably try to take their money out.”

2020 Melbourne Lord Mayor candidate Wayne Tseng answered some questions about his campaign for the upcoming election from Wikinews. The Lord Mayor election in the Australian city is scheduled to take place this week.

Tseng runs a firm called eTranslate, which helps software developers to make the software available to the users. In the candidate’s questionnaire, Tseng said eTranslate had led to him working with all three tiers of the government. He previously belonged to the Australian Liberal Party, but has left since then, to run for mayorship as an independent candidate.

Tseng is of Chinese descent, having moved to Australia with his parents from Vietnam. Graduated in Brisbane, Tseng received his PhD in Melbourne and has been living in the city, he told Wikinews. Tseng also formed Chinese Precinct Chamber of Commerce, an organisation responsible for many “community bond building initiatives”, the Lord Mayor candidate told Wikinews.

Tseng discussed his plans for leading Melbourne, recovering from COVID-19, and “Democracy 2.0” to ensure concerns of minorities in the city were also heard. Tseng also focused on the importance of the multi-culture aspect and talked about making Melbourne the capital of the aboriginals. Tseng also explained why he thinks Melbourne is poised to be a world city by 2030.

Tseng’s deputy Lord Mayor candidate Gricol Yang is a Commercial Banker and works for ANZ Banking Group.

Currently, Sally Capp is the Lord Mayor of Melbourne, the Victorian capital. Capp was elected as an interim Lord Mayor in mid-2018 after the former Lord Mayor Robert Doyle resigned from his position after sexual assault allegations. Doyle served as the Lord Mayor of Melbourne for almost a decade since 2008.

NCAA Football: USC banned from bowl games for two seasons, wins vacated

The University of Southern California’s football team was heavily penalized by the National Collegiate Athletic Association (NCAA) yesterday due to several major rules violations involving former player and Heisman Trophy winner Reggie Bush. The team was banned from participating in all NCAA bowl games for the 2010 and 2011 seasons, as well as was vacated of all wins during the 2004 and 2005 seasons. The team will likely also be stripped of their national title from the 2004 season and will lose ten football scholarships per year for the 2010, 2011, and 2012 seasons.

The NCAA also criticized the university for ineffective monitoring of its student-athletes. “The general campus environment surrounding the violations troubled the committee. At least at the time of the football violations, there was relatively little effective monitoring of, among others, football locker rooms and sidelines, and there existed a general post-game locker room environment that made compliance efforts difficult,” said part of the NCAA’s report.

The rules violations, which were investigated by the NCAA over a four-year period, involved the team’s alleged “improper benefits,” given to Bush, as well as Bush’s contact with an agent, which is illegal under NCAA rules until a player has left the sports program. It is also possible that this will result in the loss of Bush’s Heisman Trophy. The NCAA report ordered USC to not be in contact with Bush for the current time.

“We acknowledge that violations occurred and we take full responsibility for them. However, we sharply disagree with many of the findings in the NCAA Committee on Infractions Report. Further, we feel the penalties imposed are too severe for the violations identified in the report,” stated Todd Dickey, the senior vice president of administration at USC.

Meanwhile, Reggie Bush (who now plays for the NFL’s New Orleans Saints) also released a statement. “I am disappointed by the decision and disagree with the NCAA’s findings. If the University decides to appeal, I will continue to cooperate with the NCAA and USC, as I did during the investigation. In the meantime, I will continue to focus on making a positive impact for the University and for the community where I live,” said Bush. Bush denies all of the allegations brought against him and the university by the NCAA.

The report also included punishments for the men’s basketball team, which was accused of violating the NCAA’s recruiting policy on former player O.J. Mayo. The women’s tennis team was also fined for allowing an unidentified student to use a university-owned credit card to place $7,000 in unauthorized phone calls.
